Suspend, Cancel Vehicle Registration, Penalize Owners for Not having PUC- Supreme Court comes strong on violators.
State of MP Vs. Centre for Environment Protection Research and Development ( Civil Appeal 8932-8933/2015).
The SC has come strong and directed MP to suspend/cancel the registration certificate of vehicles which do not possess valid pollution under control certificate and also to initiate penal measures against the owner.
The National Green Tribunal has the power, authority, and jurisdiction to direct a state govt. to strictly implement the requirement of vehicles to possess, display valid PUC.
The court also held that vehicles that do not possess or display cannot be debarred from the fuel supply. NGT had asked for INR 25 crores as security for compliance, which the court rejected and said NGT cannot require a monetary deposit for compliance.
Court stated that strong measures must be taken to protect the environment and improve the air quality whenever there is a contravention of statutory rules causing environmental pollution. Stringent action has to be taken but in accordance with law.
