Constitution (scheduled tribes) order (Amendment) Bill, 2021

Mr. Arjun Munda, the Minister for Tribal Affairs, introduced the Constitution (Scheduled Tribes) Order (Amendment) Bill, 2021, in the Rajya Sabha on August 2, 2021. The Constitution (Scheduled Tribes) Order, 1950 is amended by the Bill. The President has the authority under the Constitution to designate Scheduled Tribes (STs) in various states and union territories. The bill was passed by voice vote amid protest by the opposition over issues of Pegasus, agri laws and others.

The bill provides for modifying Part-XVIII of the Schedule to the Constitution (Scheduled Tribes) Order, 1950, relating to the state of Arunachal Pradesh. According to the government, the alteration to the Scheduled Tribes list will not result in any additional recurring spending from the Consolidated Fund of India due to benefits that are likely to be offered to people who belong to the communities specified in the bill. 

The Proposed changes in list of Scheduled Tribes in Arunachal Pradesh under the Bill are as follows:

  • It provides for deletion of 'Abor' (tribe) in serial No. 1,  ..
  • It replaces ‘Tai Kampti’ instead of Kampti
  • It also provides for inclusion of 'Mishmi-Kaman (Miju Mishmi ) 'Idu (Mishmi)and 'Taraon (Digaru Mishmi)' in serial No. 8  ..in lieu of 'Mishmi, Idu, Taraon' in the list.
  • It provides for the inclusion of 'Momba', 'Memba', 'Sartang', 'Sajolang (Miji)' in serial No. 9 in lieu of 'Momba' in the  list.
  • It also provides for inclusion of 'Nocte', 'Tangsa', 'Tutsa' , ‘wancho’ in lieu of  ‘Any naga tribes’ in serial no 10 of the list.
